The US Rigging Supply mobile message service (the "Service") is operated by “US Rigging Supply”, “we”, or “us”. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides [Updates, alerts, and information (e.g., order updates, account alerts, etc.)] [Promotions, specials, and other marketing offers (e.g., cart reminders)] from [US Rigging Supply] via text messages through your wireless provider to the mobile number you provided. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number.  

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

WARRANTY

U.S. RIGGING SUPPLY WARRANTS THAT THE GOODS SHALL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP FOR A PERIOD OF NINETY (90) DAYS FROM THE DATE OF DELIVERY TO CUSTOMER. Any claim of defects not made within said ninety (90) day period are waived and released. Seller’s sole responsibility with respect to claims made within said ninety (90) day period is, at its option, to repair or to replace any goods which it deems to be defective. The foregoing warranty does not apply if repair or replacement of the goods is required as a result of causes other than normal use, including, without limitation, repair, maintenance, alteration, or modification of the goods by persons other than Seller: addition of goods not supplied by Seller; accidents; failure of any items not provided by Seller; fault or negligence of Customer; operator error or improper use or misuse of the goods; causes external to the goods such as, but not limited to, transportation, theft, fire or water damage; and uses which do not meet manufacturer’s specifications. Seller is not responsible for any failure to provide service, parts, or replacements due to circumstances beyond its control. OTHER THAN AS FORTH ABOVE IN THIS PARAGRAPH, U.S. RIGGING SUPPLY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE GOODS (INCLUDING, WITHOUT LIMITATION, WARRANTIES AS TO MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE AND WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE), WHETHER EXPRESS OR IMPLIED. THE ABOVE EXPRESS WARRANTY IS IN LIEU OF ALL OBLIGATIONS OR LIABILITIES ON THE PART OF SELLER FOR DAMAGES, INCLUDING, BUT NOT LIMITED TO LOST PROFITS AND SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE GOODS PROVIDED BY SELLER.

LIMITATION OF LIABILITY

Buyer's remedies under this agreement are subject to any limitations contained in manufacturer's terms and conditions to U.S. Rigging Supply, a copy of which will be furnished upon written request. Furthermore, U.S. Rigging Supply's liability shall be limited to either repair or replacement of the goods or refund of the purchase price, all at U.S. Rigging Supply's option, and IN NO CASE SHALL U.S. RIGGING SUPPLY BE LIABLE FOR INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. In addition, claims for shortages, other than loss in transit, must be made in writing not more than five (5) days after receipt of shipment.

WAIVER

The failure of U.S. RIGGING SUPPLY to insist upon the performance of any of the terms or conditions of this agreement or to exercise any right here under shall not be deemed to be a waiver of such terms, conditions, or rights in the future, nor shall it be deemed to be a waiver of any other term, condition, or right under this agreement.

ASSIGNMENT

Buyer shall not assign its rights or delegate its duties here under or any interest herein without the prior written consent of U.S. RIGGING SUPPLY, and any such assignment, without such consent, shall be void.

Notice: U.S. Rigging Supply logo, ProClimb logo, SwageRight logo, and DuraBrite logo are registered trademarks of U.S. Rigging Supply, Inc. and are protected in the United States and abroad. All other trademarks contained within are the property of their respective owners. We are not responsible for typographical or photographic errors.

SPECIFICATIONS

Any performance stipulations by U.S. Rigging Supply are conditional on the ultimate user or consumer's determination of the following: proper size and type, proper design and maintenance of the equipment which products are used; and proper storage, maintenance and periodic inspection of such products during the period of use. The dimensions, weights, strengths and other specifications shown in this website are approximates, subject to variation within reasonable tolerances, and not to be solely used to determine the suitability for any specific application.

Breaking Load is calculated by random sample testing at our own facility. The product is tested to point of breaking or deformation (an unusable state). Breaking Loads are measured in pounds. Test certificates available upon request.

Important: Safe Work Load is determined by application; ranging from 5 (or 20% of breaking strength) for non-overhead applications, 10 (or 10% of breaking strength) for overhead applications, 15 for life lines.
